Quick answer
Urgent funding to pay the ATO is usually property-secured, because a lender can approve against property far faster than it can assess full financials. Settlement is possible in as little as 24 hours for property-secured loans when the paperwork is ready, though a few business days is more common. While funding is arranged, tell the ATO in writing that finance is under way. It may give you time, but there's no guarantee.

Which deadlines make ATO debt urgent?
Some ATO letters are reminders. Others start a clock that doesn’t stop because you’ve called. Before you do anything else, work out which one you’re facing:
| What you’ve received | The clock | What happens if it runs out |
|---|---|---|
| Director penalty notice | 21 days from the date of issue | Options that remove personal liability close |
| Creditor’s statutory demand | 21 days from service | The company is presumed insolvent |
| Garnishee notice | Immediate | Money is taken from your bank or debtors |
| Payment plan default | Varies | The full balance becomes payable |
| Wind-up application | Court date set | The court may order liquidation |
The DPN date runs from when the ATO issued the notice, not when you opened it. If the letter sat in a pile for a week, you have less time than you think. See the first 21 days of a DPN and statutory demands.
How fast can tax debt funding actually settle?
The honest answer depends on three things: the type of security, how ready your paperwork is, and how simple the property is.
- Property-secured, simple property, documents ready: settlement is possible in as little as 24 hours. This usually means a caveat loan or a fast second mortgage.
- Property-secured, normal case: a few business days. Valuations, title searches and existing lender consents take time.
- Unsecured, steady bank statements: often quick for smaller amounts, but limited by turnover and existing repayments.
- Bank refinance: usually weeks. Rarely fast enough for a 21-day deadline, though it can be the long-term exit from a short-term loan.
If the deadline is very close, a fast short-term loan to clear the ATO can be followed by a cheaper, longer refinance once the pressure is off. That two-step approach is common. Just make sure the exit is realistic before you start. See bridging loans for ATO debt.
What slows urgent funding down?
Most delays have nothing to do with the lender’s credit decision. They come from missing pieces:
- No ATO statement. The lender needs to see the exact balance and the tax types. Download it from Online services or ask your tax agent today.
- Unknown property details. Title, current loan balance, and the existing lender’s details for second mortgages.
- Co-owners not available. Everyone on title usually needs to sign. If a co-owner is overseas, say so on day one.
- Overdue lodgements. If BAS or returns are unlodged, the real debt may be different. See low doc tax debt loans.
- Mismatched figures. Turnover in the enquiry that doesn’t match bank statements costs days. Give real numbers.
What should you tell the ATO while funding is arranged?
Contact the ATO, or have your tax agent do it, and say plainly that finance is being arranged to pay the debt. Give the expected settlement date and, if possible, something in writing from the lender showing the application is under way. The ATO considers each case on its own facts. Evidence of a real plan can lead it to hold off on firmer action for a short time. It can also decline.
What you should not do is promise a date you can’t meet. A missed promise makes the next conversation harder.
For a DPN or a statutory demand, the clock is set by law. A conversation with the ATO doesn’t extend it. Take legal or accounting advice the same day.
An illustrative example
A Perth electrical contractor receives a DPN covering $142,000 of unpaid PAYG withholding and super guarantee. Nine days of the 21 have already passed because the letter went to an old address. The director owns a home with good equity. A caveat loan is approved on day 11 and settles on day 14, paying the ATO directly. The director keeps the payment confirmation, and three months later refinances the caveat loan into a longer second mortgage with lower repayments.
This example is illustrative and simplified, not a real client.
Is a fast loan always the right move?
No. Speed has a cost, and urgency can push people into borrowing that doesn’t fix anything. Pause if:
- the business is losing money every month and the ATO debt will simply rebuild;
- you can’t explain how a short-term loan will be repaid or refinanced;
- the ATO would accept a payment plan you can afford, and no fixed legal deadline applies.
In those cases an ATO payment plan or independent advice may be the better first call.

Frequently asked questions
How fast can I get a loan to pay the ATO?
For property-secured loans, settlement is possible in as little as 24 hours when the documents are ready and the property is straightforward. A few business days is more common. Unsecured loans can also move quickly, but depend on clean bank statements and a moderate amount.
What's the fastest type of loan for ATO debt?
Usually a caveat loan or another short-term loan secured over property. The lender relies on the property's equity, so it doesn't need to wait for financial statements. It's built as a short-term bridge and is often refinanced later into a longer loan.
Will the ATO wait if I tell them a loan is coming?
Sometimes. The ATO looks at your circumstances and history, and evidence of finance being arranged can help. It's not a right. Put it in writing, give a realistic date, and don't miss it. For court-based deadlines such as a statutory demand, take legal advice as well.
I've received a statutory demand. Is it too late for a loan?
Not necessarily, but the clock is short. A company has 21 days to pay or otherwise deal with a statutory demand, or it's presumed insolvent. Funding needs to settle inside that window. Get legal advice straight away too.
Do I need perfect credit for urgent ATO funding?
No. Existing ATO debt, payment-plan defaults and past credit issues are considered case by case. Property-secured lenders focus on the equity and the plan to repay. There's no credit check when you first enquire.
